ACCEPTABLE USE POLICY

This Acceptable Use Policy (“Policy”) governs the access to and use of the Platform and Services provided by Peko Payment Services LLC, together with its affiliates (“Peko”, “we”, “us”, or “our”).

By accessing or using the Platform or any Services, you agree to comply with this Policy, as updated from time to time. This Policy forms part of, and is incorporated by reference into, the Peko Platform Agreement, Privacy Policy and any applicable Corporate Card Terms and Conditions.

These rules, as well as any guidelines published by Peko on its Platform from time to time, are binding on all users. Peko may modify this Policy at any time by posting a revised version on the Platform. By using the Service or accessing the Platform, you agree to the latest version of this Policy. You must refrain from using the Services and the Platform in any manner that contradicts these rules, standards, or applicable law in the relevant jurisdiction. For the purpose of this Policy, the term Services shall refer to the services made available by Peko and third party service providers through Peko’s Platform.

PROHIBITED ACTIVITIES While accessing the Platform and using the Services, you, or any third party accessing the Services and the Platform through you, will not:

  1. Use the Services or the Platform for any illegal, defamatory or fraudulent purpose or in violation of any laws including without limitation data, privacy, consumer protection, and export control laws;
  2. Violate or incite the violation of the rights of others;
  3. Probe, scan, or test the vulnerability of any system or network;
  4. Breach or circumvent any security or authentication measures;
  5. Access, tamper with, or use non-public areas or parts of the Services without authorization;
  6. Interfere with or disrupt any user, host, or network, such as by sending viruses, overloading, flooding, spamming, or mail-bombing any part of the Services or the Platform;
  7. Knowingly in any way use the Service or the Platform in any manner that would result in an infringement, dilution, misappropriation or other violation any intellectual property or proprietary rights of others, including but not limited to copyrights and rights arising from patents, trademarks and trade secrets (including the intellectual property rights or brand names of Peko or any of its partners or merchants);
  8. Access, search, or create accounts for the Services through unauthorized means, such as “scraping” or bulk account creation;
  9. Send unsolicited communications, promotions, advertisements, or spam;
  10. Send altered, deceptive, or false source-identifying information, including “spoofing” or “phishing”;
  11. Promote or advertise products or services without appropriate authorization;
  12. Abuse referrals or promotions to obtain more paid features than entitled;
  13. Circumvent the limitations of your paid subscription, if applicable;
  14. Sell, resell, or transfer or distribute the Services or the Platform in part or entirety to any third party under any circumstances;
  15. Use the Services in a manner inconsistent with their intended business or financial purpose, or rely on the Services as the sole control mechanism in circumstances where such reliance could reasonably be expected to result in material harm or regulatory non-compliance;
  16. Access the Platform using unauthorized devices, software, scripts, bots, or integrations that bypass security controls or published access methods;
  17. Publish or share materials that are unlawfully pornographic, indecent, or violent;
  18. Advocate bigotry or hatred against any person or group based on race, religion, ethnicity, sex, gender identity, sexual preference, disability, or impairment;
  19. Use the Services or the Platform to violate the privacy or confidentiality of others, including by transmitting, storing, displaying, distributing or otherwise making available others' private or confidential information (including without limitation their account names or personal data associated with their Service) without authorization; and
  20. Use the Services or any payment instruments, including Corporate Cards, in connection with any individual, entity, jurisdiction, goods, or services that are subject to sanctions, restrictions, or prohibitions under applicable laws, including those issued or implemented by the United Arab Emirates, the United Nations, or other relevant authorities.
  21. Use the Services or Corporate Cards for transactions that are restricted, prohibited, or blocked by applicable law, Card Network rules, Issuer requirements, or Peko’s internal risk and compliance controls.
  22. Take any action that Peko reasonably determines, acting in good faith and in accordance with applicable law and industry standards, to be inconsistent with acceptable business practices or the integrity of the Platform.

ENFORCEMENT

Violation of this Policy may result in suspension or termination of access to the Platform and Services and, where applicable, suspension or termination of access to payment instruments, including Corporate Cards, in accordance with the applicable terms.

Peko may take such enforcement action where it reasonably believes that a violation has occurred, including where the violation is unintentional or occurs without the User’s direct authorization, or where such action is required by applicable law, regulatory authorities, Card Networks, or the issuing financial institution, and where necessary to ensure legal or regulatory compliance or to protect the rights, safety, security, or property of Peko, its partners, customers, or third parties.

Where reasonably practicable and permitted by law or regulatory obligations, Peko may provide notice or an opportunity to remedy the violation prior to suspension or termination.

Peko reserves the right, but does not assume the obligation, to investigate any suspected violation of this Policy or misuse of the Platform or Services, to remove or restrict access to content or activity that it reasonably determines to be non-compliant, and to report suspected unlawful activity to regulators, law enforcement authorities, or other appropriate third parties, including by disclosing information as required or permitted by applicable law.

THIRD-PARTY SERVICES

Peko collaborates with third-party service providers to deliver certain Services through the Platform. You acknowledge and agree that Peko shall not be responsible or liable for any actions, errors, omissions, or breaches of these third-party service providers, except to the extent required under applicable law. The use of such Services shall be governed by the terms and conditions of the respective third-party providers.

COMPLIANCE WITH THIRD-PARTY STANDARDS

You agree to comply with any additional policies, guidelines, or acceptable use restrictions imposed by third-party service providers whose services are utilized in conjunction with the Services provided by Peko.

YOUR RESPONSIBILITY

You are responsible for violations of this Policy by anyone using the Services or the Platform with your permission or using your account on an unauthorized basis. Your use of the Services or the Platform to assist another person in an activity that would violate this Policy if performed by you is a violation of this Policy. This Policy applies to any action directly or indirectly taken, authorized, facilitated, promoted, encouraged, or permitted by a user, whether or not the user directly performed the act.

This Policy shall be governed by and construed in accordance with the governing law and dispute resolution provisions set out in Peko’s Platform Agreement in effect at the relevant time.

Any collection, use, disclosure, or sharing of personal data under this Policy shall be carried out in accordance with applicable data protection laws and Peko’s Privacy Policy.

Anything not expressly covered under this Policy shall be governed by the applicable laws, rules, regulations, and industry standards in the relevant jurisdiction. In addition, such matters may also be subject to the terms and conditions, privacy policies, end-user license agreements (EULAs), service level agreements (SLAs), or any other agreements or policies applicable to the use of the Services or the Platform, as published or made available by Peko or its affiliated entities from time to time. In the event of any conflict or ambiguity, the provisions of such agreements and policies, along with the applicable law, shall prevail.

Reporting Violations: If you become aware of any violation of this Policy, you must immediately notify Peko by email at legal@peko.one and provide us with assistance, as requested, to stop or remedy the violation.
